Child support is the right of the child and is governed under different legislation depending on whether or not the parties were married to each other. If the parties were married to each other then child support claims are made under the Divorce Act, which is Federal legislation. If the parties were not married to each other then a claim for child support is made under the Family Law Act which is provincial legislation.

Child support is based on the income of the payor and at times child support can be paid on an offset depending on the parenting time the parties’ have with the child(ren). There are several other factors that are considered when determining the amount of child support on a monthly basis. These factors include the parenting time, how many children there are, the incomes of the parties, the age of the children, etc.

Child support is paid for so long as a child is dependant on the party(ies) which can include when the child is attending post-secondary schooling or if the child is disabled. There is typically an annual review of child support to determine if a change is required based on the payor’s income.

An aspect of child support are special or extraordinary expenses which are paid in addition to monthly child support. Some examples of special or extraordinary expenses are child care expenses, uninsured medical and/or dental expenses, extracurricular activities and expenses for post-secondary education to name a few. Special or extraordinary expenses can vary from family to family.
